Operating facility permit support

I guide you through permit procedures for operating facilities (Betriebsanlagen) under §74ff of the Austrian Trade Regulation Act (Gewerbeordnung, GewO), either in full from the project outline to the final and binding official decision (Bescheid), or selectively for individual stages. Not legal representation, but specialist technical support: I provide the documents, moderate contacts with the authority and prepare appointments.

Frequently asked questions

Do I always need a lawyer for an operating facility permit procedure?
In most cases, no. The GewO does not require you to be represented. For the technical preparation and communication with the authority, an engineering office with the relevant experience is usually sufficient. Legal support is only needed for legal disputes or appeal proceedings; in such cases I work with specialised law firms.
How long does a typical permit procedure take?
By law, the simplified procedure takes up to three months and the ordinary procedure six months. In practice, you have to add preparation, queries from the authority and, where necessary, re-planning. Four to nine months from the first submission of documents to the official decision is realistic, depending on complexity and on how busy the district authority is.
When does external technical project management make sense?
Whenever the project is technically demanding and there is no full-time internal resource for it. Typical examples: plant investments in the six- or seven-figure range, extensions that require a permit, or conversions during ongoing operations. For standard construction projects, a conventional planning office is usually enough.
Which documents are needed for a permit procedure?
The core is a technical description, plans showing the machine layout and escape routes, emissions assessments (noise, exhaust air, waste) and, depending on the facility, fire protection and occupational safety concepts. The exact list depends on the type of procedure and the type of facility. As a first step, I draw up a checklist tailored to your project.
