Periodic self-inspection under § 82b GewO

Periodic inspection of your approved operating facility (Betriebsanlage), objective, fully documented and ready for scrutiny by the authorities. As a suitably qualified expert (geeigneter Fachkundiger) under §82b GewO (Austrian Trade Regulation Act), I issue the inspection certificate myself.

Qualification

I am certified as a suitably qualified expert under § 82b GewO and can formally carry out the inspection and issue the inspection certificate. This is based on my training as an industrial engineer plus the qualifying examination for engineering offices (Beratende Ingenieure), in the field of industrial engineering in mechanical engineering, as well as eight years as a labour inspector with a focus on technical occupational safety and operating facility law.

What is the § 82b inspection about?

Under § 82b of the Trade Regulation Act, facility owners are obliged to check at regular intervals, on their own responsibility, whether their facility complies with the permit decision (Genehmigungsbescheid) and all relevant regulations, at the latest every five or six years. The aim is to ensure that the business is operated in line with the permit (Konsens): that is, as the authority approved it at the time (and as it still expects it to be today).

The inspection covers:

  • Comparison of the current state with the permit decision and supplementary decisions
  • Check of compliance with technical, organisational and safety-related permit conditions
  • Assessment of whether conversions or process changes give rise to new requirements
  • Identification of ongoing obligations (periodic inspections, records, maintenance)
  • Identification and documentation of defects or deviations
  • Preparation of the inspection certificate under §82b Abs. 1 GewO

What happens at the §82b appointment?

Four clear steps, from the first document check to the finished inspection certificate.

    Reviewing the documents

    I review the permit decision, supplementary decisions and any standing permit conditions for your facility. This produces a clear overview of which conditions are still valid today and which have been superseded by later conversions or decisions.

    On-site walk-through

    Comparison of the actual condition of the facility with the approved permit status. Documentation of compliance with technical, organisational and safety-related permit conditions, with photos and measurements where necessary.

    Assessment and findings

    Identification of defects or deviations, professional classification (which are relevant to the authority and which are not) and recommendation of corrective measures with realistic deadlines.

    Inspection certificate under §82b

    You receive a properly issued inspection certificate under § 82b Abs. 1 GewO, which must be kept until the next inspection certificate is available and presented to the trade authority on request, and which remains documented and available from me at any time.

Frequently asked questions from practice

When is my next self-inspection due?

Standard interval: five years (for facilities covered by § 359b GewO: six years, §82b Abs. 1 GewO). You will find the date of the last inspection on the last inspection certificate. If that is missing, we reconstruct it from the trade permit decisions.

What happens if I have missed the inspection?

If §82b is breached, the facility owner commits an administrative offence punishable by a fine of up to € 2,180 (§ 367 GewO). More importantly, though: during a visit by the authority or the Labour Inspectorate (Arbeitsinspektorat), you will come under pressure. In that case, I carry out the inspection immediately, pragmatically and without any fuss.

What if documents are missing or the facility is old?

That is the normal case. Many approved facilities are decades old, decisions are scattered, and conversions have not always been documented afterwards. I reconstruct the permit situation from the existing decisions and, if necessary, by inspecting the authority’s file.
